This morning USATT General Counsel, Dennis Taylor , and USATT CEO Mike Cavanaugh joined Steve Smith, outside counsel from Colorado Springs representing USATT, in an American Arbitration Association (AAA) hearing.  Athletes Mark Hazinski and Raghu Nadmichettu were represented by Counsel Ed Williams.  AAA had assigned Jeff Benz as the arbitrator for the hearing.

At issue was the suspension decision rendered by the USATT Ethics Committee on Mark Hazinski’s and Raghu Nadmichettu’s right to compete in the National Team Trails taking place at Texas Wesleyan University, March 4 & 5, 2010.  Following a teleconference hearing that was in excess of four (4) hours, the following preliminary report was issued by the arbitrator:   

Dear Parties and Counsel:

After full briefing and a hearing, and after having considered the arguments and submissions of the claimants and respondent, and the relevant law/rules, the arbitrator has determined that the athletes should be permitted to compete in the event set to start today in Dallas.  A reasoned award, with additional guidance for the parties, will follow in short order.
